It is very important that all single family and duplex property owners in Lawson Hill read the proposed documents before attending the meeting. Please note; the documents linked above were drafted by San Miguel County Staff with input from the Lawson Hill Board of Directors.
The Lawson Hill Board of Directors has pursued clarification of the deed restriction with San Miguel County since they became aware of changes that had been made to the LUC, which could impact owners in the Lawson Hill Association. The original deed restriction on your property is a plat note which came directly from the San Miguel County Land Use Code (LUC Section 5-1304) the plat note tied the deed restriction to the County Land Use Code Section 5-1305 “Affordable Housing Guidelines, Rules and Regulations”. It was never anticipated by individual owners or the board that changes might be made to the Land Use Code that could change the rules even after the purchase of deed restricted properties or that it may continue to be amended over time.
The Board, our attorney, Tom Kennedy, and San Miguel County staff, Mike Rozycki, Lynn Black and Becky King have worked hard to draft a new agreement, agreeable to both parties. The outcome of these years of conversations and negotiations is “The Proposed Amended and Restated Deed Restriction and Covenant”. The document addresses many vague aspects to the original Land Use Code language including retirement, disabilities, price capping, inheritance, continued ownership, and ownership of other residential real estate.
This meeting is important to all owners who wish to avail themselves of the work that has been done on their behalf. The acceptance of this agreement is optional. Each owner of single family or duplex deed restricted property in Lawson Hill will have the opportunity to sign this new agreement, once signed the agreement would run with the land and be recorded with the property deed. If an owner chooses not to sign, they would remain under the “Original Deed Restriction” and the current plat note for their deed would remain in place.
We highly recommend you attend this special meeting and take advantage of the opportunity to ask questions of Lawson Hill’s attorney, board members and the San Miguel County staff, regarding your deed restriction and the new proposed covenant.
